Commercial Law

Commercial law pertains to the law which regulates the rights, relations and disputes between individuals and businesses engaging in commerce, merchandising, sales and trade in a broad range of industries including finance, technology, retail, manufacturing, supply and distribution etc.

A commercial contract is a legally binding agreement between two or more parties in which they are obligated to perform or restrained from performing certain acts.  Contracts must be drafted and reviewed carefully and legal proceedings must be conducted effectively in case of a dispute.

Liquidation

B Gouws Inc. Attorneys will guide you on the process of liquidation as it can sometimes be utilised as a tool in debt and asset recovery. More often than not, the liquidation procedure is faster and more cost-effective than instituting legal action.

Sequestration & Rehabilitation

Sequestration is the surrender of an individual's estate to the High Court in terms of the Insolvency Act 24 of 1936. Sequestration can be voluntary or compulsory. In both instances, the consequences of the sequestration order are the same.

Rehabilitation of an insolvent brings the sequestration of his estate to an end. Although it was the estate of the insolvent that was sequestrated, it is the insolvent himself, not the estate, that is rehabilitated.
